Public checkout stores the identifiers for the Terms, Privacy, cancellation, claims, and prohibited-items versions presented with the order, and rejects a stale checkout page.
Prepared goods only
The sender describes, packages, and makes each lawful item ready for a curbside or agreed handoff before the driver arrives.
One order, one private record
Confirmation, tracking, cancellation, refund, proof, and claim status stay together in one private order record. The public WB- order number identifies the delivery but does not grant access.
1. Agreement and contracting party
These Terms of Service (“Terms”) govern access to the Wayboro website and account-level platform features, including public delivery checkout. Delivery-specific customer obligations apply to the person or entity that places the order. “Wayboro,” “we,” “us,” and “our” mean Nazar Adamovych, 31 Queens Way, Camillus, NY 13031, United States. A customer agrees by checking the acceptance box and submitting an order. An account user agrees when the relevant account flow presents these Terms and records that user's assent. Delivery checkout also incorporates the policies linked beside its acceptance control.
Customer placing an order
Accepts the recorded checkout versions and is responsible for the order, item, payment, and participant information supplied.
Sender or recipient
May receive coordination and tracking access but is not charged merely because the customer named that person on an order.
Driver or applicant
Uses these Terms for website and account access. They are not a driver services agreement and do not decide worker classification, pay, insurance, or screening authorization.
Business API customer
Public checkout does not authorize Business API use. API-created orders require a separate written agreement, which controls where it expressly conflicts with these Terms.
2. Who may use the service
You must be at least 18 years old and legally able to enter a contract. If you order for a company or another person, you represent that you have authority to do so. You may use the service only for lawful purposes and in compliance with applicable federal, state, and local law.
3. What Wayboro delivers
Wayboro accepts prepared, lawful goods that match the order description and can be transported safely in the assigned vehicle. Wayboro is not a passenger service, shopping service, household mover, storage provider, or regulated-item delivery program. Pickup must originate within the service area displayed before quoting. A destination must be routable and within territory Wayboro is legally authorized and operationally able to serve.
An accepted order is a request for the delivery shown in the confirmation. We may refuse or cancel an order if it is unlawful, unsafe, outside authority or service coverage, materially inaccurate, or cannot be completed with available capacity. A payment authorization or automated confirmation does not require us to perform an unlawful delivery.
4. Sender responsibilities
You are responsible for:
- giving complete and accurate addresses, contacts, access instructions, item contents, quantity, dimensions, weight, condition, and value;
- having ownership, custody, or other legal authority to tender every item;
- ensuring all items are ready at the pickup time and both locations are safe and reasonably accessible;
- obtaining authority to provide sender and recipient contact information, telling those people that Wayboro and an assigned driver will use it to complete and document the delivery, and not naming anyone who objects;
- ensuring no item violates the Prohibited Items Policy; and
- following lawful safety and inspection requests at pickup.
5. Packaging and inspection
You must separately identify every item group and accurately report the total physical quantity. A group may contain only identical items with the same packaging, vehicle fit, weight band, and handling needs. The current service accepts no more than ten physical items per order. You must package, seal, label, and secure every item for ordinary road transport, handling, weather, and its known fragility. Wayboro does not choose packaging for you. Before taking custody, Wayboro or the assigned driver may visually inspect the items and request that packaging be opened when reasonably necessary to verify safety, condition, dimensions, or policy compliance. We may refuse an item if inspection is lawfully refused or it cannot be transported safely.
6. Quotes, charges, payment, and tax
Before checkout, the site displays the delivery subtotal, service fee, applicable tax calculation, and total. Quotes expire at the time shown and depend on the submitted route and order details. If an address, item, stop, time, or other material fact changes before payment, edit the order and obtain a current quote. The public website does not modify a paid order or automatically add return, waiting, toll, parking, redelivery, or storage charges after checkout. Use the private tracking page to request help if a paid order is no longer accurate. Any future supplemental-charge mechanism must disclose the amount and obtain separate acceptance before imposing it unless applicable law permits otherwise.
The service fee is calculated from the active pricing rule and shown as a separate amount before payment. The exact service fee accepted at checkout is stored with the quote and order; it is not a driver tip. Checkout may group the service fee and estimated tax into one display line while retaining each amount separately in transaction records. Payment processing is performed by the provider identified at checkout. You authorize the displayed total and any later charge you separately approve. Taxes are collected only where and to the extent Wayboro is required and registered to collect them. A payment dispute does not eliminate valid rights or obligations under applicable law.
A driver tip is optional. The amount selected before payment is added to the displayed total and locked with the paid order; the current public checkout accepts tips from $0 through $100 and does not support changing a tip after payment. Wayboro does not reduce the stored driver offer because of a tip. After successful delivery, 100% of the stored tip is included in the assigned driver's earnings in addition to that offer. If the entire customer payment is refunded, the tip is included in that refund and the related driver earning, if any, is reversed. A refund remains incomplete while the payment provider reports it as pending, failed, or canceled.
7. Service levels and timing
“Scheduled” means an eligible requested window; “Priority” means prioritized dispatch. They describe dispatch treatment, not a guaranteed arrival time. Traffic, weather, closures, safety, sender or recipient delay, and events outside reasonable control can affect pickup and delivery.
8. Pickup, proof, delivery, and returns
Pickup, delivery, and an authorized return require a photograph and the name of the person releasing or receiving the item. Proof records a timestamp and may include a factual note. Arrival and return workflows may also use operational location data. When recipient PIN protection is selected for an order, the recipient must provide the current six-digit code at delivery before that proof can be completed. The code appears only through the active private tracking link, changes if that capability is rotated, and is not stored raw on the order or proof. Do not include unrelated people, documents, or private information in a proof photograph. A tracking link is a private bearer-style link; anyone who receives it may see the order information made available through that link, so you must protect it.
If delivery cannot be completed after pickup, the driver must report the issue and Wayboro operations may authorize a return to the original pickup. The sender must reasonably cooperate with a prompt, safe, and lawful return. The current public service does not offer customer-selectable redelivery or storage, and it does not impose a separate public return, redelivery, waiting, or storage fee. Temporary custody needed to coordinate a safe return is not a storage service.
9. Cancellation and refunds
The Cancellation and Refund Policy explains when a cancellation is operationally possible and how refunds are handled. It is incorporated into these Terms. Cancellation and refund are separate actions; a refund is not complete until the payment provider has processed it.
10. Cargo loss, damage, and claims
The Claims Policy explains how to report an incident and preserve evidence. A declared value helps describe the shipment. It is not insurance, a purchased protection plan, a promise to pay that amount, or—without a legally valid written released-value agreement—a limitation of liability.
Carrier liability and remedies may be governed by nonwaivable state or federal transportation law, including federal law for qualifying interstate transportation. Nothing in these Terms shortens a deadline, limits liability, or waives a remedy where the law does not permit it. Wayboro does not sell cargo insurance or a shipment protection plan unless a separate written offer at checkout states the insurer or obligor, coverage, price, exclusions, and governing terms.
11. Privacy and communications
The Privacy Notice explains how personal information is handled. Service emails concerning a quote, payment, dispatch, delivery, return, safety issue, or claim are transactional communications. Marketing email is subject to separate choice and applicable law. Wayboro will not send automated marketing texts or enroll a number in a recurring text program without the separate consent and disclosures required for that program.
12. Acceptable platform use and content
You may not misuse the website, attempt unauthorized access, interfere with security, scrape private information, impersonate another person, or use tracking links outside the delivery purpose. You retain ownership of photographs, descriptions, and instructions you submit. You grant Wayboro a limited license to host, copy, disclose, and use that content only as reasonably necessary to quote, perform, document, support, secure, and resolve the delivery or comply with law.
13. Suspension and termination
We may restrict access or refuse future orders for fraud, safety risk, abusive or discriminatory conduct, repeated material misdescription, nonpayment, prohibited items, platform misuse, or legal or regulatory necessity. We will not exercise this right in a manner prohibited by law. Terms that by their nature should survive—including payment, claims, evidence, privacy, intellectual property, and dispute provisions—continue after an order ends.
14. Disclaimers and responsibility
To the extent permitted by law, the website and dispatch features are provided on an “as available” basis, and we do not promise uninterrupted access or a delivery time not expressly guaranteed in writing. We do not disclaim duties, cargo liability, warranties, or consumer remedies that cannot lawfully be disclaimed.
To the extent permitted by law, neither party is responsible to the other for indirect, incidental, special, exemplary, or consequential damages that were not reasonably foreseeable. This sentence does not apply to physical injury, willful misconduct, fraud, confidentiality or privacy violations, indemnity obligations to a third party, cargo liability governed by controlling transportation law, or any liability that cannot lawfully be limited.
You will defend and indemnify Wayboro against a third-party claim to the extent caused by your unlawful item, lack of authority to tender it, material misdescription, infringement of third-party rights, or material breach of these Terms. This provision does not require a consumer to indemnify Wayboro for Wayboro’s own negligence, legal violation, or other responsibility that cannot be shifted by law.
15. Governing law and disputes
Contact us first so the parties can try to resolve a dispute informally. New York law governs these Terms, without regard to conflict-of-law rules, except where federal law or a consumer’s nonwaivable home-state law controls. Subject to those rights, proceedings may be brought in a state or federal court with jurisdiction in Onondaga County, New York. These Terms do not impose mandatory arbitration or a class-action waiver. Eligible claims may be brought in small-claims court.
16. Changes and general terms
For a new public order, Wayboro records the Terms, Privacy, Prohibited Items, Cancellation, and Claims versions presented at checkout. The recorded versions govern that order unless the parties lawfully agree otherwise. Existing orders are not assigned a later policy version merely because the website changes. Material changes apply prospectively and receive notice and renewed assent when required. If one provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A delay in enforcement is not a waiver. You may not transfer an order or these Terms without consent; Wayboro may transfer them as part of a lawful merger, financing, reorganization, or sale, with required notice.
